Charges dropped against biker involved in assault on SUV

It is a brutal video. It ends with a group of bikers attacking an SUV. They pulled the driver out of the vehicle and beat him in front of his family. That's after the driver ran over a biker after an incident moments earlier. But now prosecutors dropped charges against one of the bikers, saying he was possibly trying to protect the driver. CNN's Susan Candiotti has the latest.

Anderson discussed this with CNN legal analysts Mark Geragos and Sunny Hostin

It may be the law to stop at the scene after driving over the bike and biker, but keep in mind if you just did that because you were in fear of your life or that of your family, you would not do so when you're outnumbered about 500 to 1.

Marc seems to think that the bikers were upset because the suv driver accidentally hit the biker from behind. The video I saw clearly shows that the biker deliberately stopped so that the suv had no choice but to hit him from behind. They were acting like animals. The bikers say that we haven't seen what happened before the altercation, if the driver did something to warrant this attack than show us what that was.

In the video you can clearly see Mr. Cruz actually already in the same lane as the SUV, riding very close to driver's window and looking into SUV. He then moves to a position just in front of SUV and slows, NY does not allow "lane splitting" to my knowledge, and is one of the reasons he was charged with reckless driving. The bottom line, SUV driver stopped after first contact, then chose to flee instead of fight when he saw the situation turn chaotic. A reasonable action considering the circumstances.
