Toobin is incorrect in stating that Americans did not have an individual right to keep and bear arms prior to 2008. The Supreme Court did not address the issue until 2008. The previous ruling (Miller) addressed the firearm itself and not the individual. Nevertheless, we don't rely solely on the Supreme Court to tell us what rights we have. We have all of the rights that we commonly believe we have until such time as there is a ruling. The right to keep and bear arms was always considered an individual right until the 20th Century.
