There is no way you can convince me that the black and white version of that photo wasn't manipulated as much as possible. I've downloaded the color photo and converted it to black and white, the base conversion plainly shows the blood on his lip, and I can make out the blood on his right cheek.
Based on this manipulation alone the case against ZImm should be thrown out.
