I have felt badly for Penn State and now I feel they are a part of the criminal act because they are hiding behind this exemption.
The open records laws in PA apply to State schools and as counter-intuitive as it may seem, Penn State is not a State school. The legislature of PA chose to largely de-fund Penn State (Temple, Pitt, and Lincoln also) over the past 30 years. Penn State is as close to a private institution as one could imagine. So while I share in the frustration of not having all the answers at the moment, It was the legislature that turned its back on the best State schools in the commonwealth, and I surely don't blame them for seeking an exemption from State school status if they are not going to enjoy the same funding levels of other State schools.
