Tonight, we’re taking another look at the controversial actions of Joe Horn. Back in November, the Texas man shot to death two men robbing his next door neighbor’s house. That’s even after a 911 dispatcher told him not to do it. Yesterday, as we told you on 360, a grand jury said Horn should NOT be prosecuted. They said he broke no laws. Yet, the legal decision has our nation divded ( just check out the reaction to this story in last night’s Evening Buzz). Could this case set a dangerous precedent as some fear? We’ll be looking at that tonight on 360.
Also, breaking news – manhunt over.
The search for a man suspected of killing at least 8 people over the last several days in Illinois and Missouri has ended. The victims included a child and a 93-year-old man. Tonight, we’re on the scene with the latest developments. We’re also looking at what would drive someone to go on a killing spree.
And, left for dead. A woman collapses in a hospital waiting room and what happens next?
Nothing. OK, well, not quite nothing. Almost everything that does happen, will make your blood boil. We’re keeping them honest.

Many people are very sick of the crime around their neighborhoods. They are sick of waiting for our “officials” to do anything about it. If these guys were caught, instead of shot, they would most likely be deported and they could come back easily. When folks start protecting their neighbor’s property instead of just letting it happen, it reminds me of how things used to be 40 years ago. We weren’t afraid of being arrested or sued if we “got involved” in stopping someone for stealing, rapeing, murdering, etc. |

July 1st, 2008 10:27 pm ET I think that this incident may be an indicator of what is to come in the future, especially after the recent ruling from the Supreme Court. Inevitably gun violence will increase in the short term after this ruling but eventually it should fall to historic lows. Robbers will realize their lives aren’t worth whatever they might find in someone’s home. Finally, I agree that he is neither a hero or a vigilante he was doing what he thought was right, he was just a man who saw burglars in his neighbor’s yard and wanted to protect himself and his property. |

July 1st, 2008 10:45 pm ET “Could this case set a dangerous precedent as some fear?” Oh, the horror! Citizens acting proactively to stamp out crime. Torres and Ortiz were illegal immigrants from Colombia. Torres was deported in 1999 after a 1994 cocaine-related conviction. Grand jury indictments are not difficult to get, since the prosecutor largely controls the process. The GJ’s refusal to indict says a great deal about the weakness of the case. Posters to the Evening Buzz were largely supportive of Horn, and rightfully so. Breaking into someone’s house does not reflect well on one’s character. As far as I’m concerned, one gives up one’s rights during one’s commission of a crime. And don’t quote law to me – it’s an ethical judgment that I’m quite comfortable with. Torres’ and Ortiz’s future assault/rape/murder victims owe a great deal to Horn. A happy ending. I’m sleeping well. |

Horn had been asked to watch the neighbors house, and he wouldn’t have been doing a very good job of that if he let men break into the house and rob it. |

July 1st, 2008 10:51 pm ET I think Horn is a hero. I used to sympathize with criminals when they were shot by the police until I was held at gunpoint and assaulted. I almost got killed. I have since never had any sympathy with criminals who are summarily executed. Mr Horn is a good citizen, and I encourage anyone with a gun to emulate him. |

The test is that Horn tried to impose his own version of imminent justice on those men. I think it is quite clear that there is no way that he was threatened, the only thing that was threatened was his neighbor’s property. He volonteered to get involved and killed those thieves without being provoked. This is crazy not to prosecute him. Who is he to decide that the value of his neighbor’s property so greatly outweighed the value of two human lives so that he felt he had to cut those lives short on the spot? |

With the laws protecting the criminal more than the ciizen now, they are more bold and not afraid to do things like this. If my home was threatened, my family and even my neighbor, I would react the same way. The right to bear arms and to protect your property and to love your neighbor to me all tie together. If a burglar is at my neighbors, I will call the police, and watch carefully for anything that may help to capture the people. If they come and try to get into my home, and it appears that I am in danger, yes I have the right to protect myself at that time. However, why would I shoot them in the back, if the back is turned to me, I cant be in that much danger. People need to wake up and smell the blood! Truth is these men may have seen how easy the theft was and came back at later date to the same neighborhood. These men were in this country illegally and commiting crimes. They may have not deserve to die but our corrupt justice system would have not even seen it fit to deport them. They would have been back on the streets in a short time commiting more crimes. Such as lawmakers that don’t even live in or lived a particular lifestyle that they are trying to eradicate, or to attempt to control with words of law. There is no law enforcement personal to enforce our constitution? , When our civil rights are being denied by useless city codes, county laws and state laws. I submit that he could have shot below the waist (waste) and left them alive to face charges, but it appears that he shot them in the back. The suspects are armed with handgun teenagers estimated from 15 to 21. I hope someone gets them before an innocent is killed. The are targeting women alone or women with children. If a representative of the local police office gives orders and they are not followed he has disobeyed the law thus he should be guilty. In the 911 audio tape Mr.Horn specifically told the 911 operator that he was going to kill the thieves. Not only did he have a constitutional right to do what he did out of self defense, he did America a favor by controlling the illegal immigrant popultion! These aliens came here to do nothing but exploit this country. Case in point, robbing the household of ordinary American citizens. Stop being a bunch of hippie democrats and realize that if it were you in this situation, you would have done the same thing to protect yourself and your property. |

Any excuse to take someone out. The men were on another property UNTIL Mr. Horn confronted them by going outside of his home. The he shot them in the back. How on earth is that a threat to his safety. The next thing we know, when you brush up against someone on a bus in TX, they’ll have reason to take you out with a concealed handgun, and then walk away with no legal outcome. I wonder what the legal result would have been had Mr. Horn been Hispanic or African American and the robbery suspects been white. Would the gun rights defender have been equally enthusiastic about supporting the right to shoot down anyone who makes you feel uncomfortable? |

The police were there just as the shooting occured. He just wanted an excuse to shoot some minorities. Would this same acion had been ok if they were white young men who may have just made the wrong decision? Nobody’s life is worth taking over property that can easily be replaced or recovered. I’m pretty sure his neighbors had insurance, that is what it is for. He should have kept his scary self in the house. For all he know these men may have had starving children at home. They were unarmed and didn’t intend to hurt anyone and I’m sure didn’t approach him or his yard. |

The message that the Horn Grand Jury sent is that if you are the wrong color and in the wrong neighborhood, anyone can shoot and kill you if you are merely near their property and claim it was self-defense. Oh and the Castle doctrine passed to protect homeowners from lawsuits from the families of the criminals that they gun down. Yes..if a burglar breaks into my house…you can bet I will not ask questions and just open fire on him. But conversely, criminals will now be expecting Mr. Horn’s kind of behavior and make burglars more prone to carrying firearms in the commissions of their crimes and that puts innocent families at risk. Oh and I believe that Joe Horn committed this crime in cold blood only because they were non-white. Had these burglars been young white men, I think it’s a safe bet that Mr. Horn’s actions would have been less violent. |

If I was in the same situation and saw someone commiting burglary at my neighbors house, I would feel threatened by them. I’ve heard of burglaries in my neighborhood & even that makes me feel vulnerable… what if my house is next? The burglers are criminals and if you put yourself in that situation, you’d better expect you can be shot. |

If you are a criminal and are intent on doing a crime you should know that there is a significant chance you will get killed. What matters the crime. Let them steal, vandalize etc her property or hurt her, but as for me I hope more people will help their neighbor and so whatever is necessary including killing them. |

This country is so PC that even if a person is breaking into your house and cuts there hand in the process, they can sue you for damages. Since Katrina, Houston and it’s surrounding suburbs has seen a high rise in crime. Most of the criminals seem to be Katrina victims that had to flee to Texas from Louisiana. The criminals were on it, they had just robbed his neighbour and he acted to protect himself. Of course an item stolen is never worth a life but still. I have read about three cases where a property owner shot someone he thought was committing a crime. In all three cases, a young man ended up dead, when no crime was committed. Leave the crime fighting up to the police. We don’t need vigilantes. |

She is apply the law as she understands it in states other than Texas. She stated that there is no right to protect property with deadly force (I think her actual words were “shoot somebody over property”). That is incorrect as far as Texas goes. In Texas you can not only shoot someone for threatening your life but you can shoot them for stealing your property. and there is NO requirement to attempt to retreat. In reality, in Texas, you can not only use deadly force to prevent theivery but you can use deadly force to recover property regardless of where you find it. In Sept 07 the law was changed and it now allows you to protect your neighbors property with deadly force. Texas gun law for the Win! Tell Lisa to familiarize herself with CURRENT TEXAS LAW and try it again. And next time get a commentator who knows the law you are talking about. |

If I was on a jury I would want to go for second degree murder. If the men had broken into his home or come into Mr. Horn’s yard with malicious intent then he had every right to protect his family and his property, but legally I just don’t see how he his justified in insinuating himself into his neighbor’s situation. My grandfather was a farmer in southwestern Oklahoma and lived way out in the boondocks far away from any neighbors and he had his shotgun in his living room. Every once in a while a stranger came to the door in the night to ask for directions. He had his shotgun in his hand when he greeted them, but fortunately he never had the occasion to shoot anyone. Knowing him well, he probably would have shot someone if they had broken into his house, but if someone was looting the neighbor’s house he probably would have called the sheriff. |

If you can’t count on the cops to take care of it (and he did give them a fair chance to get there), I’d rather my neighbor stop someone robbing my place than let them get away. Shooting them might be the only option. I think if something’s going on, no help available, and you have the ability to intervene, you should intervene. We’ve got one case of a woman who spent more than 30 minutes dying on a hospital floor with other patients there and two security guards checking in briefly – no one lifts a finger. Then we’ve got no-one else around but Horn, and he risks himself to stop two criminals. I know which I’d trust more. And it certainly isn’t the lazy bastards at that hospital. |

I don’t believe the woman was mentally ill, but she was there for treatment, collapsed and died in the waiting room after complaining multiple times of her symptoms. This is pretty disturbing…have some hospital staff become so desensitized to sick people that it doesn’t occur to them that some situations are literally life and death and some may really need immediate help, or at least a triage??? Anderson, I think a “Keeping Them Honest” special report on this phenomena is in order…it’s happened too many times and I’m sure it’s happened more than I’m aware. I’m looking forward to you and Sanjay Gupta researching this. |

Since then, he’s graduated from college and is a civil engineer making six figures. I’m glad that he didn’t meet up with someone like Mr. Horn or I might have never met and married my husband. I’m tired of people defending criminals and second guessing law enforcement when they do their job or citizens like Joe Horn who got involved with protecting his community. What if his neighbors were not away and these burglars breaking in happened to be armed or armed themselves with kitchen knives once they got in? If it was happening to me, I for one would want my neighbor to shoot whoever is trying to enter my residence. If they die, then so be it – I wouldn’t want it to be me or some other innocent. |

July 1st, 2008 11:12 pm ET And what about the very possible instance where the Mr. Horn in the case is somehow wrong, misjudges or misperceives the situation and shoots someone innocent? Or shoots some kid who’s in the wrong place for the first time in his life, along for the ride without having the maturity to know what he’s doing? It’s a well-known fact now how many innocent people have been found on death row. The less we “citizens” value life, the more we value just our property and take our power to act individually, the more we’ll have primitive, militia-style or citizen executions–and some will go tragically wrong. |

July 1st, 2008 11:12 pm ET In my opinion, Mr. Horn represents what has always been the right of every American citizen… to defend himself, his property and the rights of others. These two men were illegal aliens. Not citizens. They were not there to fix his neighbors cable, they were robbing him. This was the first time they were caught. Who is to say that the next time they wouldnt have surprised someone in their home and ended up killing them in the process? |

July 1st, 2008 11:13 pm ET I have been the victim of a mugging and a burglary in my lifetime. I understand the feelings of anger and emotions that come over a person when they feel violated and victimized. With this said, human life is more precious than personal property any day and any time. This is the reason why I’ve never purchased a gun. In my view, I’d rather suffer the consequences, whatever they may be as opposed to having the live with the thought of taking a life. What has our society come to when we think that this type of vigilantee justice is appropriate. I am more afraid of people like Mr. Horn than I am of burgulars. God help this country. |

HOWEVER…. when bad people do bad things, sometimes there are bad consequences… Since the police are sometimes ineffective in keeping the peace, it is up to the homeowner to protect life and property.. For too long, VICTIMS’ RIGHTS are being whittled away while criminals rights become stronger and stronger.. If MORE incidents like this were broadcast…. maybe the potential criminal will think twice about invading the sanctity of a persons home. |

Why is the death penelty for a misdemeanor not questioned and how can our government ordain giving all people legally carrying a firearm the right of judge, jury and executioner? |

July 1st, 2008 11:14 pm ET I have lived in Texas for the past seven years. Since then we have had two cars broken into, a lawnmower stolen, tools and bicycles taken right out of our garage. Several of our neighbors have suffered the same. Maybe if more homeowners reacted like Mr. Horn, thiefs would think twice befores stealing. |

July 1st, 2008 11:14 pm ET Hello Anderson: I cannot help to be shocked by the commentaries regarding Mr. Horn’s actions in Texas and by the decision by this Texan “Grand Jury” not to bring charges against him for murder. How can someone murder two people, practically premeditated cold blooded assassinations and not being brought to justice??? What kind of “JUSTICE” is this? On the other hand we easily imprison the addicted, the mentally impaired and the poor… What an irony! |

July 1st, 2008 11:15 pm ET Response to Hero or Killer : Since this is an place to speak your mind im going to be real on this case. First of all, Horn didn’t see two robbers. Horn saw two black men. Why would he shoot two men stealing from someone he didn’t know? Were they even stealing is the question. He said that they were coming onto his property. Then why were the bodies found on his neighbors yard with bullet wounds in their back. It’s very racist because if someone of are color was to shoot two caucasions, we would’ve had life no parole. Say I’m wrong if you wish but I’ve seen it happen. |

July 1st, 2008 11:15 pm ET Mr Horn did NOT shoot them in the back. He shot them in their sides. The two robbers were running INTO Mr Horn’s yard. They were on his property when he shot them. I am so tired of the wrong facts being stated on TV. The only way to lower the crime rate in 2008 is to shoot to kill. Good job, Mr Horn! |

July 1st, 2008 11:16 pm ET horn had a right to defend himself but not on this particular day he didnt, he went out of his house to pursue the suspects, they didnt pose any immediate danger to him and he had no reason to leave his house, he comes back and says the police are here already, sounds like the cops would have got the guyz in time, he got trigger happy, I am an african immigrant and i have seen this type of justice on the streets of our third world country. Well it looks like America is walking BACK into the future, no difference between this and a thief being lynched for stealing your neighbors cow. |

July 1st, 2008 11:17 pm ET I believe that Mr Horn should be tried and convicted of killing two unarmed men. He commited murder. To call him a hero is to make mockery of the word “hero”. Mr. Horn commited a criminal act . The Texas Grand Jury that cleared Mr. Horn did a disservice to the society and they should be ashmed of their action. Mr. Horn killed two unarmed Hispanics who did not come to his home. If these men were Whites I doubt that Mr. Horn would have shot them. If these men were Whites, I doubt that those who hail Mr. Horn as their “hero” would do so. If these men were Whites, I doubt that the Texas Grand Jury would clear Mr. Horn of wrong doing. I do not support any criminal but to call Mr. Horn a hero is rather sickening. |

July 1st, 2008 11:18 pm ET There is a very fine line between defending your own property and that of your neighbor. Granted these two guys were definitely in the wrong for stealing someone else’s property, but this Horn guy is nothing short of a cold blooded murderer. If his life was in danger why were the victims shot in the back? If someone is running away then how in the world is that a threat to someone’s life? I bet the 911 operator who took the call and pleaded for him not to take justice into his own hands doesn’t think Mr. Horn’s life was in danger. If it had been a person of color who shot two white men in the back, would they be considered heroes or would they be drug behind a pickup truck, lynched in the jail, or even beaten to death on the way to jail? This is a travesty and it only shows that the judicial system is still very biast in nature. I am deeply saddened to say that in America a dog has a better chance of seeking justice than a man of color. Shame on you Texas for keeping racism alive and well. Ultimately Mr. Horn, you will have to meet the Lord on your true judgement day. The eternal burn will not be over as quickly as your gunshots to the back of those two men you MURDERED. Thank you grand jury for making this murderer named Horn the new KKK poster boy. |
